that uneasy feeling you get when you know you are soon to be "homeless"... the house we moved into last year and really settled into is being "sold" to his son. i am so angry at the landlord for doing this, especially after our lengthy conversation that posed this very question, "are you thinking about trying to sell the house any time soon? we DO NOT want to have to move again in a year. it is so hard to do, especially with a little one." ass hat response, "oh no. i love to see a family in there, and if YOU would be interested in leasing to buy, we'll talk after a year." all i can say is, i pity his foolish son who is buying this house with the crumbling foundation, flooded basement, toilets that run and run and run, moldy dishwasher that no longer drains, disposal that does not work, front door that no longer locks, barely shuts and has huge gaps from the ancient handy man's rockin skills with a planar saw (who is for some reason always topless). what i really love is that most of the above list has happened within the past 2 - 3 weeks! it's a sign, definitely time to go. the burleys are on the move again.

but it sounds to me like this is going to actually be a good thing for you, a good move. 2 things -- I agree with Etta that you should take your time and find the best place you can. Also, if you do move out before the end of the lease, you might want to see if mr. asshat will let you go without paying for that extra month that you won't be living there -- he is the one initiating this, not you.

i hate moving. this coming from someone who moved four times w/in the last year! let his son enjoy the crumbling house. sucky you gotta do it though esp w/ the little one, i hear you. i hope you find a great new place to call home.

our lease is up in april, but we've already paid our last months rent, so we're looking to move feb 29 - mar 1. the sooner the better.
p.s. etta, i was just catching up on your recent posts and reading the one about lice has suddenly made my head itch....

my head itches whenever i think about it, but that one louse and that one nit weer the only ones i found. if she gets it again, i will know it's because the school didn't deal with it properly. which they didn't. which i called the principal about, and which prompted (along with other parents' calls, i presume) a rather terse letter being sent home on friday. it starts:
"Parents:
Don't Panic!...."

i guess we're the ones pushing up the moving date. when looking for homes, they always advertise ones that are available for immediate occupancy or at the beginning of the month, so all of the ones that are worth anything go fast and usually aren't advertised for 2 months in advance. i don't want to feel like this until march when, presumably, people will advertise their places for april occupancy. also, by moving in march, we'll have the whole month of march to move every thing out, rather than having to do it quickly in 2 days. i think that we would have had a chance if i'd added something into the lease regarding what happens after the initial one year lease... but, we're turning this into a positive thing for us, to find something a little cheaper and save for a down payment on our own within the next year or so...

a tenant gets to stay in the place if it's sold. it's a law. i was asking if you have any protection like this, of if you even know that the son doesn't want to continue to rent to you.have you talked to the son?

we haven't even talked to the landlord, he left us a voice mail, and then emailed us...he hasn't answered our return call.

did he mention whether he's selling the house to his son to live in, or just that he is selling? the law in NJ is that the tenant gets to stay, unless the owner needs to live there himself. did the landlord say he's going to ask you to move? did you get ahead of yourselves?

an owner can, in NJ anyway, move his tenants out to use the house himself. probably, his son needed a place, and teh owner knew he couldn't just evict you to give it to his son, so he's officially selling the house to make it legal.

so at least you know you have a good reference from him.

the only thing that is jumping out at me is that he did this over voice mail. that is not exactly the most legal and binding way to do this. if you need more time, i am sure you can get it. to my mind, his son and fiance don't have a kid (yet), and you do, so you get preference. if you write to him and tell him that you're doing your best to find a new place, but haven't yet, i'm pretty sure he will have to let you stay. don't be shy about your rights.
