are they allowed to not fix it? aren't they FDIC insured? doesn't that mean that they are required to credit you for any funds that come out of your account after you report the stuff stolen?

They're right, there has to be a FDIC recourse. Manager only, no peons, notify the 3 major credit companies as well to protect your credit rating as well. Where were you parked when you were broken into?

get a police report, call all your credit card people and tell them the carsd have been stolen. Put a stop on all cheques, etc. from your bank account, as well as your bank card.
Also, tell anyone you've written a check to that it might bounce because of the theft.
Once you have the police report, you CAN, in fact, go to the bank and get that money returned to your account, but bankers love paperwork. Go in and talk to your branch manager, don't waste your time with a teller. They SHOULD be helping you, and giving you this kind of advice, and if they are not helpful, switch banks.

if it's the result of theft. i've been through this myself, trust me. go to the bank, meet with the manager, have them pull up your checking records and see what exactly happened to make you overdrawn. you'll have to figure out which checks were stolen and either stop payment on them or close the account entirely. they'll advise you on which to do. then you'll then have to file affidavits of forgery for each check that was drawn on your account by the theif. it might take a day or two or three, but once it's done the money that was stolen will be replaced. should be much sooner than 4-6 weeks. they will/should also cover you for any legitimate checks you wrote that haven't yet been processed. you should not be incurring ANY overdraft fees as the result of the theft. it's a total flippin headache, but you will get your money back.
I am so sorry this happened to you. I hope their nuts shrivel up and fall off!
